Exceeding the limits of authority in public office

Abstract:

The civil service is the source of the state’s power. In this sense, the civil servants are the implementing tools and backbone of the authority, reflecting it. However, if they do their work with sincerity, they reflect a good reputation for the organs of the state, and if they exceed the limits of their powers, they reflect a bad image, as they represent the state. Therefore, it is necessary to pay attention to the civil service through the development of self-confidence among employees and instilling their moral concepts, in addition to drawing up special assurances to balance between the public and private interests, to grow inside them morals such as honesty, sincerity and loyalty, achieving the public interest of society in accordance with the prescribed regulations. The employee’s sense of the responsibility entrusted to him is greatly reflected in the services he provides, in addition to the oversight of the work of that employee with detecting the defects, making special efforts, prevents the existence of administrative irregularity with the commitment to integrity and honesty. The activation of the role of such oversight would preserve the field of civil service as the source of authority, through permanent supervision and the legislator’s taking into account all aspects and details of the public service post, the rights and duties of the employee and what is the penalty the employee would be facing when exceeding the limits of the authority given to him.

Moreover, crimes that exceed the limits of the employee’s authority are subject to more severe penalties, such as the bribery, embezzlement and forgery.
